1. Introduction & These Terms

1.1 What these terms cover. These are the terms and conditions on which we supply products to you, whether these are goods or services, and the rules for using our website (our "Site").

1.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem, and other important information.

1.3 By using our Site or purchasing products/subscriptions, you acknowledge that you have read, understood, and agree to comply with these terms. If you do not agree to these terms, you must not use our Site.

2. Information About Us

2.1 Who we are. Our Site is operated by My Cosmetic Pharmacy Ltd ("we", "us", "our"). We are a company registered in England and Wales.

2.2 Pharmacy Regulation. We operate as a registered pharmacy responsible for dispensing and dispatching medications. We are regulated by the General Pharmaceutical Council (GPhC).

2.3 Prescribing Regulation. Our online clinical consultations and prescribing services are provided by UK-registered prescribers. This service is regulated by the Care Quality Commission (CQC). Each prescriber is individually licensed by their relevant regulatory body (e.g., GMC, GPhC, NMC).

3. Medical Emergencies

3.1 You must not use our website or services for emergencies. In emergencies, you should contact 999 for a medical emergency or 111 if the emergency is not life-threatening. If you experience severe adverse reactions to any medication, seek immediate emergency medical attention.

4. User Accounts & Security

4.1 Account Creation. To order prescription medications or subscriptions from our Site, you must create an account. You must provide your real name, email address, and other required registration information.

4.2 Your Eligibility. To place an order, you must:

  • Be at least eighteen (18) years old.
  • Have the legal capacity to enter into a binding contract.
  • Be a resident of the United Kingdom. We do not deliver to addresses outside the UK.

4.3 Account Security. You must treat your user identification code, password, and account details as confidential. You must not disclose them to any third party. We have the right to disable any account at any time if we reasonably believe you have failed to comply with these terms.

5. The Clinical Consultation Process

5.1 Questionnaires. Where a product requires a prescription, you must complete an initial clinical consultation in the form of an online medical questionnaire.

5.2 Accuracy of Information. The safety of our prescribing relies entirely on the accuracy of the information you provide. You confirm that all information provided during the consultation is truthful, complete, and up to date. You must not withhold any medical history or current medications.

5.3 ID Verification. To issue a prescription, we must verify your identity and age. We may use third-party verification partners (such as Stripe Identity or Yoti) to automatically check your details, or we may ask you to upload photo identification. If we cannot verify your identity, we will not issue a prescription.

5.4 Clinical Reviews. You may be required to complete regular clinical reviews throughout your treatment journey. We reserve the right to suspend further prescribing or dispensing until such reviews are satisfied.

6. Order Acceptance & Contract Formation

6.1 Placing Orders. Submitting an order and providing payment details is an offer from you to purchase the products. It does not mean your order has been accepted.

6.2 Clinical Approval. All orders for prescription-only medicines are subject to review by our prescribers. If our clinical team determines that a treatment is not suitable or safe for you, we will not issue a prescription and we will reject your order.

6.3 When the contract is formed. Our acceptance of your order will take place only when our prescribers have approved your consultation and we email you to confirm that your medication has been dispatched. At this point, a contract comes into existence between you and us.

6.4 Subscriptions. If you select a subscription plan, your subscription will automatically renew for the agreed period (e.g., monthly). We will charge the current subscription price using the payment method you provided. You can cancel auto-renewal at any time via your account dashboard before your next billing date.

7. Delivery

7.1 Dispatch Times. We will aim to dispatch your order as soon as reasonably possible after clinical approval. Delivery dates are estimates and not guaranteed.

7.2 Delays Outside Our Control. If our supply of products is delayed by events outside our control (such as postal strikes or extreme weather), we will take steps to minimize the effect of the delay, but we will not be liable for the delay itself.

7.3 Failed Delivery. If no one is available at your address to take delivery, our delivery partner will leave instructions on how to rearrange delivery. It is your responsibility to collect or rearrange delivery of the items.

8. Cancellations and Returns

8.1 Order Cancellations. You may cancel your order and receive a full refund at any time before your medication has been dispatched by our pharmacy team.

8.2 Statutory Exemptions (No Returns on Medication). For reasons of health protection, hygiene, and safety, the standard 14-day statutory cooling-off period does not apply to prescription medicines or pharmacy-dispensed products.

8.3 By UK law, we cannot accept returns of any prescription medications once they have been dispatched from our registered pharmacy premises, even if the package remains unopened. Returned medicines cannot be restocked or reused and must be destroyed safely.

8.4 Faulty or Damaged Items. If your order arrives damaged, or if we have sent you the incorrect medication, please contact us within 48 hours. Do not consume damaged medication. We will arrange a safe disposal and send a replacement immediately at no cost to you.

9. Our Liability to You

9.1 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, the negligence of our employees, agents, or prescribers, or for fraud.

9.2 We are not liable for any loss, damage, or health complication resulting from:

  • Your failure to provide accurate, truthful, and complete medical information during your consultation.
  • Your failure to follow the medical instructions, dosage guidelines, or patient information leaflets provided with your treatment.
  • Your use of our website or services for an emergency medical situation.

9.3 Consumer Use Only. We only supply products for domestic and private use. If you use the products for any commercial, business, or resale purpose, we will have no liability to you for any loss of profit, loss of business, or business interruption.

10. Intellectual Property

10.1 We are the owner or the licensee of all intellectual property rights in our Site and the material published on it. These works are protected by copyright laws around the world. All such rights are reserved. You must not use any part of the content on our Site for commercial purposes without obtaining a licence from us.

11. Other Important Terms

11.1 Transfer of Rights. We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens.

11.2 Severability. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

11.3 Governing Law. These terms, their subject matter, and their formation are governed by the laws of England and Wales. You and we both agree that the courts of England and Wales will have exclusive jurisdiction over any disputes or claims.
